In considering this Reference the Tribunal, at the beginning of the hearing, reminded the representatives of the importance of focussing upon the content of the co-ordinated support (CSP) plan.

 

The Tribunal also emphasised the overriding objective in Rule 3 of The Additional Support Needs Tribunals for Scotland (Practice and Procedure) Rules 2006 (hereinafter referred to as ‘the Rules’).

 

The Tribunal were anxious to deal with the reference ‘fairly and justly’ and to be flexible in the proceedings.

 

The hearing proceeded, with the agreement of both representatives, with a careful analysis, submissions and evidence in respect of the content of the aforesaid draft CSP.

 

Both the Appellant and the Education Authority were represented.

Neither party had a Supporter.

 

The Appellant’s representative confirmed that she did not seek to amend specific pages.

 

The Tribunal proceeded to consider submissions from both representatives together with evidence from the child’s parents, the Education Officer and the Social Worker.  Further productions were lodged late on the morning of the hearing for both parties.  These productions were referred to briefly within the hearing and together with the remaining productions assisted everyone in their joint effort to seek agreement and to resolve all disputed areas within the draft CSP before the Tribunal.

 

Flowing directly from the above submissions and evidence, both representatives presented the Tribunal with an agreed wording of the CSP and invited the Tribunal to record their agreement.

 

 

The Tribunal now issue this Decision recording the ‘joint agreement’ of the final agreed wording of the content of the CSP.

Both Parties concur in the above amendments to the Co-ordinated Support Plan. The Tribunal is satisfied that the above amendments should be allowed.

 

 

The Tribunal require the Education Authority, in accordance with Section 19(4)(b) of The Education (Additional Support for Learning)(Scotland) Act 2004, to make aforesaid jointly agreed  amendments to the CSP for (the child) no later than the end of the first week of the commencement of the next school term (August 2008), having regard to  Rule 2 in calculating the aforesaid time limit and the fact that the current school summer term has  ended.
