About the Chamber

 

The Tribunals (Scotland) Act 2014 creates two new tribunals - the First-tier Tribunal for Scotland and the Upper Tribunal for Scotland - and makes the Lord President the Head of the Scottish Tribunals; and creates the post of President of the Scottish Tribunals (who is presently Lady Morag Wise).   The 2014 Act brings tribunal appointments under the remit of the Judicial Appointments Board for Scotland (JABS) and transfers administrative support of tribunals to the Scottish Courts and Tribunals Service (SCTS).  Appeals are heard in the Upper Tribunal.  There are a number of Chambers within the First-tier Tribunal for Scotland. 

The Additional Support Needs Tribunals for Scotland (ASNTS) transferred into the Health and Education Chamber of the First-tier Tribunal for Scotland on 12 January 2018, and became the Additional Support Needs jurisdiction within the Chamber.

The Health and Education Chamber will have four separate specialist jurisdictions. This diagram gives a visual representation of the Chamber and the jurisdictions that will eventually sit within it, as well as where the Chamber sits within the structure of the Scottish Tribunals.

We consider two types of appeals – references, regarding the provision of educational support under the 2004 Act; and claims, in respect of disability discrimination in school education, under the 2010 Act.
